52% of the piracy markets are concentrated in CDMX and Jalisco

A study by the National Citizen Observatory indicates that some of these markets “specialize” in some type of pirated product.

52% of the markets dedicated to the sale and marketing of pirated products in the country are located in Mexico City and Jalisco, reported Francisco Rivas, director of the National Citizen Observatory (ONC).

According to the study “Piracy in Mexico: Diagnosis of the supply and institutional actions”, of the 19 “notorious markets”, that is, of those that substantially participate in the violation of copyright through the piracy and counterfeiting of trademarks, six are located in the capital and four in Jalisco.

The other main markets dedicated to the sale of pitaría are located in the State of Mexico (Chiconcuac); Guanajuato (San Francisco del Rincón, Downtown León and Moroleón); Nuevo León (Mercado de la Pulga del Río and City Center), Puebla (Jorge Murad Macluf “La Fayuca” Shopping Center) and Chihuahua (El Pasito Plaza de la Tecnología).

Rivas explained that all the identified markets fall into one of the following categories:

  1. The areas where mostly pirated products of some kind are traded.
  2. The products that are sold are not allowed to be marketed by any authority.
  3. They do not have the copyright for the use of a trademark and this is being used during the production process or in the final marketed product.

In the presentation of the study, which was carried out this Thursday, the director of the ONC highlighted that piracy has become consolidated as a criminal activity with high economic profits and low risks for those who carry it out. He indicated that although it is minimized, it is a conduct that is related to various crimes and even organized crime.

In that sense, he stressed that in the case of Mexico City, the Tepito Union is one of the main criminal groups related to the sale of piracy.

Rivas also warned that piracy has evolved to such a degree that it is increasingly available to people without their knowledge of it, since the market for pirated products has diversified to such an extent that there are medicines, medical equipment, products agricultural products, auto parts, toys, and even pirated food products that can be marketed both in the formal sector, such as supermarkets, and in the informal sector.

No work against piracy

The director of the Observatory reported that this study showed that the government’s anti-piracy strategy has a low priority on the country’s public and political agenda, in addition to the fact that so far the administration of President Andrés Manuel López Obrador has registered a significant weakening of the institutions in charge of prosecuting piracy, such as the Office of the Attorney General of the Republic (FGR) .

According to the analysis, “since 2019, a passive attitude of the FGR and in particular, of the Specialized Unit for Investigation of Crimes against Copyright and Industrial Property, was identified, characterized by the decrease in its operational actions.”

Francisco Rivas also criticized that in this administration, in an effort to save, officials from federal agencies have had to resort to the consumption of pirated products such as software for their computers as well as public purchases, especially medicines and medical equipment.

“The federation has abandoned the FGR, and we need to take up the issue of piracy because this is evidence that corruption in Mexico is allowed and, moreover, it is encouraged,” said the director of the ONC.
